If a person passes without a will or trust, property will pass according to the intestate succession statute and if the estate is worth more than $166,000.00, a probate will be necessary. If a person drafts a will, and the estate is worth more than $166,000.00 the property will pass according to the will, but probate is still necessary. Executor fees, Attorney fees and court costs can be quite expensive in probate and the process takes almost a year to complete. Many families have found that establishing a living trust now, and funding the trust, is a cost-effective way to avoid the time and expense of probate. If you have a smaller estate, chances are, a will is all you need.
