Living Trusts Versus Wills


Clients frequently ask, "Should I get a will or a living trust?" The short answer is, "If you own real property, you should consider a living trust." If a person passes without a will or trust, property will pass according to the intestate succession statute and if the estate is worth more than $184,500.00, a probate will be necessary. If a person drafts a will, and the estate is worth more than $184,500.00 the property will pass according to the will, but probate is still necessary. Executor fees, Attorney fees and court costs can be quite expensive in probate and the process takes almost a year to complete. Many families have found that establishing a living trust now, and funding the trust, is a cost-effective way to avoid the time and expense of probate. If you have a smaller estate, chances are, a will is all you need.

Probate Assistance


If your loved one has passed without a living trust, we can examine the estate to see if we can distribute the property without a probate. If a probate is necessary, we will be happy to help you through each step of the process until the wishes of your loved one are accomplished. If your loved one died with a living trust, we can also help you with the paperwork necessary to administer the estate or refer you on to one of our team of experienced trust administration attorneys if your trust is more complicated.

To draft a simple revocable trust, we charge $2,000.00 plus costs for a single person with one house and $2,200.00 plus costs for a couple with one house. We also charge $300.00 plus costs for each additional property. Wills cost $750.00 for a couple and $500.00 for a single person.
