How Long Does It Take to Settle My Case?

Before our attorneys can conclude your case, our office needs convincing documentation to back up your claim, including medical records and billing statements for any medical treatments. If you’ve experienced property damage in an auto accident, your case can be settled as soon as our office sets up a claim with the responsible insurance company and you have a vehicle inspection done. For auto accidents, our office will also need property damage photographs, witness statements, police reports, and proof of lost income from your employer. The length of time it takes to settle your case depends on the amount of documentation as well as your insurance company. If your insurance company disagrees with our office’s evaluation, a lawsuit may have to be filed. If a lawsuit isn’t necessary, the settlement will take about 60 to 90 days after your documentation is submitted.

If the case settles without the need to file a lawsuit, our office charges 28 percent of the total settlement. If we do need to file a lawsuit, we charge 33.33 percent of the total settlement. If your case requires a jury trial (a rare situation), we charge 40 percent of the total settlement.
